Section 9528 / Military Opt-Out

Attn Parents and Students:

High School student records including names, addresses and telephone listings are made available to U.S. military recruiters through a new “open door” access based on Section 9528 of the 2001 No Child Left Behind Law.  Provisions are also made in this same Section 9528(a)(2) for students to opt themselves out.  It reads:  “CONSENT – A secondary school student or the parent of the student may request that the student’s name, address and telephone listing…..not be released without prior written parental consent...”  This section also required school districts to inform students and parents of their right to “opt-out” of having their student directory information released to military recruiters.
